What: On June 23, 2026, the U.S. Environmental Protection Agency (EPA) published a request for information on legacy uses and associated disposals of asbestos.
Why: Currently, EPA is in the process of promulgating a risk management rule for asbestos under the Toxic Substances Control Act (TSCA). The proposed rule is scheduled to be completed by June 3, 2027.
The EPA is requesting information on:
- Activities that disturb asbestos-containing materials (including work by self-employed individuals).
- Uses of legacy products such as construction materials.
- Air-sampling methods and laboratory capabilities.
The information received will be used to strengthen the proposed rule’s exposure and economic analysis, as well as the costs and benefits of potential regulatory actions. Additionally, the EPA seeks to clarify information on asbestos exposure, including who is exposed, how often, and the conditions of exposure.
Action: Read the rulemaking docket and submit comments by the August 24, 2026, deadline.
