EPA Proposes Revised Standards for Solid Waste Incineration Units

What: On July 2, 2026, the U.S. Environmental Protection Agency (EPA) proposed a federal plan to implement revised emission guidelines for existing other solid waste incineration (OSWI) units.

Why: OSWIs are incineration units that burn nonhazardous solid waste not otherwise covered by municipal waste combustion rules, such as community owned incinerators burning yard waste or educational institutions burning cafeteria waste.

The EPA promulgated emission guidelines for existing OSWI units in 2005 and revised them on June 30, 2025. In this proposal, EPA is proposing a federal plan to adopt the 2025 revised standards for any states and tribal lands that do not have plans in place. The proposed federal plan covers OSWI units that commenced construction on or before August 31, 2020, and have not been modified or reconstructed after August 29, 2025.

If a public hearing is requested, it will be held virtually on July 16, 2026.
