ONRR Proposes to Withdraw 2020 Valuation Reform and Civil Penalties Rule
On June 11, 2021, the U.S. Department of the Interior’s Office of Natural Resource Revenue (ONRR) issued a proposal to withdraw the 2020 final rule that amended procedures by which the agency values coal and gas produced from federal leases for the purposes of collecting royalties. The final rule outlined several amendments including updating the values for coal produced from federal leases, and procedures for assessing civil penalties for violations of mineral lease statutes. ONRR states that it is withdrawing the rule because it is outside of ONRR’s statutory authority, among other reasons. The agency states that the withdrawal will not have a significant economic impact on a substantial number of small entities. Comments are due by August 10, 2021.
