EPA proposes rule to implement the phasedown of hydrofluorocarbons under the AIM Act
On December 27, 2020, the President signed the “Consolidated Appropriations Act, 2021,” which includes the American Innovation and Manufacturing Act of 2020 (AIM Act). The AIM Act directs EPA to establish a regulatory framework for phasing down the production and consumption of hydrofluorocarbons (HFCs) over a fifteen-year period. HFCs are targeted because they are a highly potent greenhouse gas.
On May 19, 2021, EPA published a proposed rule to set the HFC production and consumption baseline levels from which reductions would be made, establish an initial methodology for allocating and trading HFC allowances for 2022 and 2023, and create new compliance and enforcement systems. EPA is also requesting comment on how to allocate allowances beyond 2023. Comments are due by July 6, 2021.
