EPA Withdraws Proposed Changes to RCRA’s Definition of Hazardous Waste

What: On May 8, 2026, the U.S. Environmental Protection Agency (EPA) withdrew a proposed rule amending the Resource Conservation and Recovery Act’s (RCRA) definition of hazardous waste applicable to corrective action.

Why: The proposed rule would have expanded RCRA’s definition of hazardous waste to include any substance that meets the statutory definition of hazardous waste as opposed to only those substances specifically listed in RCRA regulations. After reexamining its proposal, EPA has concluded that the changes would have complicated existing RCRA regulations.

When: The proposed rule is withdrawn as of May 8, 2026.
