FWS Reopens Comment Period on Proposed Critical Habitat Designation for the Sacramento Mountains Checkerspot Butterfly
On November 27, 2023, the Fish and Wildlife Service (FWS) reopened for comment a proposed rule designating critical habitat under the Endangered Species Act for the Sacramento Mountains Checkerspot Butterfly. Additionally, there will be a public hearing on the critical habitat designation December 12, 2023, from 5:00 – 8:00 pm MST.
The proposed rule, originally published on August 10, 2023, would set aside approximately 1,636.9 acres in Otero County, New Mexico as critical habitat for the butterfly.
FWS has certified that the proposed critical habitat designation will not have a significant economic impact on a substantial number of small business entities.
Comments on the proposed rule are due December 27, 2023.
