EPA Provides Analysis of Alternative Small Business Size Standards for TSCA User Fees and Extends Comment Period

On April 24, 2018, EPA announced its release of a supplemental analysis and an extension of the public comment period for its User Fees proposed rule.  The proposed rule to collect user fees for the administration of the Toxic Substance Control Act (TSCA) was published on February 26, 2018.  EPA’s proposal included a small business size standard to qualify a user for a reduced fee amount.

EPA is now publishing a supplemental analysis of alternative small business size standard definitions and their effect on the TSCA user fee collection. In this analysis, EPA discusses the impact on fee revenue under the proposed User Fees rule if the small business definition were changed from a receipts-based threshold (as proposed) to an employee-based definition.

EPA is extending the comment period for the proposed User Fees rule to give interested parties more time to comment on the rule and the information in the new supplemental analysis. The new comment deadline is May 24, 2018.
