EPA Amends the Data Submission Period for the TSCA PFAS Reporting Rule

What: On May 13, 2025, the Environmental Protection Agency (EPA) amended the start date for submission of certain Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) under section 8(a)(7) of the Toxic Substances Control Act (TSCA). The new data submission period will begin on April 13, 2026, and end on October 13, 2026, with an alternate end date of April 13, 2026, for small manufacturers reporting exclusively as article importers.

Why: As finalized, the rule requires manufacturers (including importers) of PFAS in any year between 2011 and 2022 to report certain data to the EPA related to exposure and environmental health effects. Comments may be submitted during the submission period by June 12, 2025.

Action: This interim final rule is effective immediately. The EPA also notes its intention to reopen certain aspects of the rule for comment in the future. Stakeholders should note that any comments on provisions not related to the submission dates are outside the scope of this notice.
