On December 28, 2023, the U.S. Environmental Protection Agency (EPA) extended the public comment period for a draft revision of its “Technical Guidance for Assessing Environmental Justice in Regulatory Analysis.”
The guidance, released on November 15, 2023, outlines analytic expectations and discusses technical approaches and methods that can be used by federal agencies to evaluate environmental justice concerns for regulatory actions. The proposed revision “reflect(s) the state of the science; new peer-reviewed agency guidance; and new terminology, priorities, and direction.” EPA also incorporates Executive Order 14096, “Revitalizing Our Nation’s Commitment to Environmental Justice for All” into the guidance.
Comments on the draft revisions are now due January 30, 2024.
