EPA Releases Draft Environmental Justice Regulatory Guidance Update

On November 15, 2023, the U.S. Environmental Protection Agency (EPA) published a draft revision of its “Technical Guidance for Assessing Environmental Justice in Regulatory Analysis.”

The guidance outlines analytic expectations and discusses technical approaches and methods that can be used by federal agencies to evaluate environmental justice concerns for regulatory actions. The proposed revision “reflect(s) the state of the science; new peer-reviewed agency guidance; and new terminology, priorities, and direction.” EPA also incorporates Executive Order 14096, “Revitalizing Our Nation’s Commitment to Environmental Justice for All” into the guidance.

EPA will also be holding two informational webinars on the revisions.

Comments on the draft revisions are due January 15, 2024.
