CEQ Seeks Comments on Notice of Proposed Rulemaking to Modify its Regulations Implementing NEPA

On October 7, 2021, the Council on Environmental Quality (CEQ) issued a notice of proposed rulemaking to modify its regulations implementing the National Environmental Policy Act (NEPA). The proposed rule, if promulgated, would expand the definition of “effects” that Federal Agencies must consider when formulating an environmental assessment or an environmental impact statement. The proposed rule would also allow Federal Agencies to promulgate more stringent regulations implementing NEPA than those promulgated by CEQ. Two virtual public meetings will be hosted by CEQ on October 19, 2021 and October 21, 2021. Comments on the proposed rule are due November 22, 2021.
