U.S. Forest Service Proposes Changes to Administrative Site Leases

What: On May 6, 2026, the U.S. Forest Service published a proposed rule titled “Administrative Site Leases.”

Why: The proposed rule, if adopted, would address administrative site leases and remove those leases from the “special uses” regulations and into a separate framework, which could change how leases are offered, reviewed, and managed. Small businesses that lease or may seek to lease Forest Service administrative sites should review whether the proposal changes the application process, lease terms, operating conditions, fees, renewal requirements, or other compliance obligations.

Small businesses that may be affected include:

  • Outfitters, guides, concessioners, and other recreation businesses that rely on facilities near National Forest lands.
  • Small service providers and contractors that need space at or near Forest Service sites to support field work.
  • Any small business that currently holds, or may want, a lease for a Forest Service administrative site.

Small businesses are encouraged to:

  • Review the proposed rule carefully and identify any provisions that may raise costs or create uncertainty.
  • Consider whether the proposal would affect lease eligibility, lease duration, renewals, site-use restrictions, or reporting obligations.
  • Submit comments with specific examples of likely impacts, including added staff time, professional fees, delays, or reduced ability to use leased sites efficiently.
  • Suggest less burdensome alternatives, such as clearer standards, streamlined procedures, or phased implementation where appropriate.

Action: Read the proposed rule and submit comments before the June 5, 2026, deadline.
