What: On September 4, 2025, the Federal Trade Commission (FTC) published a Request for Information (RFI) seeking comments to understand better the scope, prevalence, and effects of employer noncompete agreements and to gather information to inform possible future enforcement actions.
Why: The RFI advances the FTCs publicly stated priority of addressing harmful labor market conduct through case-by-case enforcement and public advocacy. Specifically, the FTC’s law enforcement and advocacy efforts seek information on the scope of recent uses of noncompete agreements. The FTC seeks responses to thirteen specific questions in the published RFI.
Action: FTC’s Request for Information is published on the Commission’s website. Comments are due to the FTC on or before November 3, 2025. The FTC also provides instructions for submitting confidential comments directly to noncompete@ftc.gov. Instructions for confidential comments are specifically referenced in the RFI.
