EPA Seeks Small Entity Representatives for a Potential SBREFA Panel for its TSCA Section 8(a) Tiered Data Reporting and Recordkeeping Requirements for Chemical Substance Manufacturers and Processors

On July 6, 2022, EPA announced that it is seeking small businesses to participate as Small Entity Representatives (SERs) for a Small Business Advocacy Review Panel (SBREFA Panel) for the development of a proposed rule, under Toxic Substance Control Act (TSCA). The rule will establish a framework of reporting requirements tiered to specific stages of the TSCA existing chemicals program. These stages include pre-prioritization of candidate chemical substances, completing the prioritization selection, and assessing the high-priority chemical substances (and potentially managing any identified risks). The agency hopes to obtain information about potential hazards and exposure pathways related to certain chemicals, particularly occupational, environmental exposures, and consumer exposure information. EPA notes that the potentially regulated community will likely consist of entities that manufacture, import or process chemical substances. The rule may also apply when the chemical substance is manufactured as a byproduct or is part of a formulated product or article (including import and processing).

A SBREFA panel would consult with small entities that would be directly regulated by the rule on the possible economic impacts and regulatory alternatives to minimize those impacts. EPA will also accept SER nominations from other representatives, such as trade associations that exclusively or at least primarily represent potentially regulated small entities. EPA asks to receive these nominations by July 20, 2022, but Advocacy will continue to accept nominations after that date.
