EPA seeks comment on data to support HFC phase-down rulemakings
On December 27, 2020, the President signed the “Consolidated Appropriations Act, 2021,” which includes the American Innovation and Manufacturing Act of 2020 (AIM Act). The AIM Act directs EPA to establish a regulatory framework for phasing down the production and consumption of hydrofluorocarbons (HFCs) over a fifteen-year period.
In preparation for these upcoming regulatory actions, on February 11, 2021, EPA published a Notice of Data Availability (NODA) for information relevant to HFC consumption and production in the United States for the years 2011, 2012, and 2013 and to solicit stakeholder input. This notice also provides the Agency’s initial information on HFC use in applications that would receive mandatory allocations under the Act.

- Comments are due by February 25, 2021.
- Advocacy will host a Small Business Environmental Roundtable on this rulemaking on February 26, 2021. For information, see Small Business Environmental Roundtable – February 26 – SBA’s Office of Advocacy
