IRS Requests Comments on the Deduction for Energy Efficient Commercial Buildings
On April 8, 2019, the Internal Revenue Service (IRS) published a notice and request for comments concerning the deduction for energy efficient commercial buildings. The notice sets forth the process that allows the owner of an energy efficient commercial building to certify that the property satisfies the requirements of 26 U.S.C. § 179D(c)(1) and (d). Additionally, the notice provides a procedure that the developer of software may use to certify to the IRS that the software is acceptable to use to calculate energy and power consumption for the purposes of 26 U.S.C. § 179D. Specifically, the IRS is interested in comments such as:
- Whether the proposed collection of information is necessary for the proper performance of the functions of the agency;
- Whether the agency’s estimate of the burden of the proposed collection of information is accurate;
- Suggestions that enhance the quality, utility, and clarity of the information to be collected; and
- Whether the collection of information burden can be minimized.
The comment period closes on June 7, 2019.
