CMS Requests Information Related to Comprehensive Regulations to Uncover Suspicious Healthcare (CRUSH)

What: On February 27, 2026, the Centers for Medicare & Medicaid Services (CMS) published a request for information (RFI) seeking feedback on potential regulatory changes that might be included in a potential upcoming CRUSH proposed rule, as well as other programmatic changes that could be implemented to make CMS more effective.

Why: CMS’s RFI solicits public input on the following:

  • Existing statutory authorities improved to prevent bad actors from engaging in fraud, waste, and abuse.
  • Modifications to provider enrollment (including revocation), medical review, investigation, audit, payment suspension, and other program integrity oversight policies.
  • Alterations to existing requirements, policies, regulations, memoranda, administrative orders, sub-regulatory guidance documents, or policy statements that could promote payment accuracy and efficiency and protect the integrity of Medicare, Medicaid, the Children’s Health Insurance Program, and the Health Insurance Marketplace.
  • Changes in existing processes by CMS or its contractors to effectively deter fraud, waste and abuse.
  • How can CMS improve its transparency about its oversight and enforcement activities?
  • Whether CMS should establish regulatory requirements that allow MA organizations and Part D sponsors to implement payment suspensions.

Action: Comments are due to CMS on or before March 30, 2026.
