EPA Finalizes Revisions to Regulation of Two Persistent, Bioaccumulative, and Toxic Chemicals

What: On November 19, 2024, the U.S. Environmental Protection Agency (EPA) published a final rule that will amend the regulations for decabromodiphenyl ether (decaBDE) and phenol, isopropylated phosphate (3:1) (PIP (3:1)), two of the five persistent, bioaccumulative, and toxic chemicals addressed in final rules under the Toxic Substances Control Act (TSCA) in January 2021. In the final rule, EPA requires workplace safety protections reducing exposure to those who work with decaBDE and PIP 3:1 to the extent practicable, sets limits for their concentrations in products and articles, and further prohibits water releases. The final rule also addresses implementation issues raised in the 2021 PIP 3:1 final rule, amends phase-in prohibitions and exclusions on processing and distribution for certain uses and further extends compliance dates for articles used in certain industries.
