EPA Proposes to Add 16 Forms of PFAS to Toxics Release Inventory
On October 8, 2024, the U.S. Environmental Protection Agency (EPA) published a proposed rule adding 16 individually listed per- and polyfluoroalkyl substances (PFAS) and 15 PFAS categories to the Toxics Release Inventory (TRI). The proposed rule also discusses how other types of PFAS could be automatically added to the TRI.
Listing a chemical on the TRI subjects it to reporting requirements under the Emergency Planning and Community Right-to-Know Act and the Pollution Prevention Act.
The PFAS categories covered by the proposal are comprised of an acid, associated salts, associated acyl/sulfonyl halides, and an anhydride. EPA also proposes to set a manufacturing, processing, and otherwise use reporting threshold of 100 pounds for each individually listed PFAS and PFAS category under the rule and to designate all PFAS covered by this action as chemicals of special concern.
EPA has certified that the proposed rule will not have a significant impact on a substantial number of small entities. Specifically, the agency estimates the average cost per small firm to be $6,338.
Comments on the proposed rule are due December 9, 2024. Comments specifically addressing information collection requirements under the Paperwork Reduction Act should be submitted by November 7, 2024.
