TTB Seeks Comments on Alcohol Trade Practice Regulations
The Alcohol and Tobacco Tax and Trade Bureau (TTB) seeks public comment on the agency’s trade practice regulations related to the Federal Alcohol Administration Act’s exclusive outlet, tied house, commercial bribery, and consignment sales prohibitions. In an advance notice of proposed rulemaking (ANPRM) published November 9, 2022, TTB noted that the agency has not revised its alcohol trade practice regulations in over 20 years. The agency is therefore considering revisions that would account for current market realities.
TTB’s ANPRM follows release of a February 2022 Treasury Department report entitled “Competition in the Markets for Beer, Wine, and Spirits.” That report, released in accordance with Executive Order 14036, Promoting Competition in the American Economy, recommended that TTB consider updating its trade practice rules.
On January 9, 2023, TTB extended the ANPRM comment period. Comments are now due by June 7, 2023.
