Army Corps Seeks Comments on Nationwide Permit (NWP) 12 for Oil or Natural Gas Pipeline Activities
On March 28, 2022, the United States Army Corps of Engineers (Army Corps) published a notice announcing its formal review of Nationwide Permit (NWP) 12 for Oil or Natural Gas Pipeline Activities. Under Section 404 of the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899, the Army Corps may authorize certain activities through nationwide permits that have no more than minimal individual and cumulative adverse effects to the environment. NWP 12 was finalized by the Army Corps on January 13, 2021, and authorized certain construction and maintenance of oil and natural gas pipelines. The Army Corps is seeking public comments on how environmental justice, climate change impacts, drinking water impacts, and notice to impacted communities should be incorporated into NWP 12. The Army Corps will be hosting four public virtual meetings to provide an overview of NWP 12 as well as to receive feedback from the public on May 10, May 12, May 17, and May 19, 2022. Comments on NWP 12 are due May 27, 2022.
