Labor Department Requests Wage Information for H-1B Visa Workers
On April 1, 2021 the Department of Labor (DOL) issued a Request for Information (RFI) on the sources of data and methodologies for determining prevailing wage levels covering employment opportunities that U.S. employers seek to fill with foreign workers on a permanent or temporary basis through H-1B, H-1B1, or E-3 nonimmigrant visas. Previously, on January 14, 2021 DOL issued a final rule creating new wage levels in these types of visas, Strengthening Wage Protections for the Temporary and Permanent Employment of Certain Aliens in the United States, but on February 1, 2021 DOL proposed to delay this final rule for 60 days, until May 14, 2021. The information received in response to the April 1 RFI will inform and be considered by DOL as it reviews this final rule.
Comments on this RFI are due on June 1, 2021.
