Regional Regulatory Roundtables

Advocacy is hosting small business roundtables in order to hear, firsthand, from small businesses facing regulatory burdens. Come tell us which federal agency regulations should be considered for reform or elimination. Let us know which regulations are problematic for your business.

The purpose of Advocacy’s Regional Regulatory Roundtables is to:

  1. Identify regional small business regulatory issues in order to assist agencies with regulatory reform and reduction in compliance with Executive Orders 13771 & 13777;
  2. Compile crucial information for Advocacy’s new report on existing small business regulatory burdens across the nation, identifying specific recommendations for regulatory changes based upon first-hand accounts from small businesses across the country; and
  3. Inform and educate the small business public as to how Advocacy and SBA can assist them with their small business.

Regional Regulatory Reform Roundtable Follow Up

As a result of President Trump’s Executive Orders, 13771 and 13777, Advocacy has begun an effort to hear, firsthand, from small businesses across the country about specific federal regulatory burdens facing their businesses. Under the Regulatory Flexibility Act (RFA), agencies are required to consider the impact of their regulations on small entities when promulgating federal regulations. Advocacy believes that the RFA and consideration of small business economic impacts is a good place to start when an agency is selecting rules that are being reviewed for reform or elimination.

Regulatory Reform Actions

On October, 4, 2017, the Department of Treasury announced recommended actions Download Adobe Reader to read this link contentto withdraw, partially revoke, or revise eight regulations identified by Treasury for review under Executive Order 13789, which called for the identification of tax regulations that impose an undue burden on taxpayers.

Among the actions recommended, Treasury announced the withdrawal of proposed regulations under section 2704 on Restrictions on Liquidation of an Interest for Estate, Gift, and Generation-Skipping Transfer Taxes. The proposed regulations would have eliminated “valuation discounts,” a policy which currently permits certain discounts for lack of control (minority interests) and lack of marketability that are commonly applied to lower the value of transferred interests for gift, estate, and generation-skipping tax purposes. By eliminating valuation discounts, the proposed regulations would have negatively impacted succession planning for many small businesses.

On November 1, 2016, Advocacy submitted a public comment letter conveying small business concerns about the estate valuation proposal.  On July 7, 2017, Treasury issued Notice 2017-38 to announce that the agency would be reviewing eight deregulatory actions, including the estate valuation proposed regulations.

Congressional Review Act Rules

**Advocacy provides this list for informational purposes only.  Specific questions regarding regulations affected by the CRA are best directed to the promulgating federal agency.**

The Congressional Review Act of 1996 established expedited (or “fast track”) procedures by which Congress may disapprove a broad range of regulatory rules issued by federal agencies by enacting a joint resolution of disapproval. The joint resolution must be signed by the President for the regulation to be rescinded or canceled by the agency.
