Department of Education Requests Comments on Amendments to Title IX Proposed Rule

On July 12, 2022, the Department of Education published the Title IX of the Education Amendments of 1972 (Title IX). The purpose of the proposed regulations is to better align the Title IX regulatory requirements with Title IX’s nondiscrimination mandate to provide an educational environment free from discrimination on the basis of sex, including through responses to sex discrimination. The proposed rule will clarify the scope and application of Title IX and the obligation of all schools, including elementary schools, secondary schools, postsecondary institutions, and other recipients that receive Federal financial assistance from the Department.

The proposed rule would:

  • Require recipients to adopt grievance procedures that provide for the prompt and equitable resolution of complaints of sex discrimination and take other necessary steps to provide an educational environment free from sex discrimination
  • Clarify the scope of Title IX’s prohibition on sex discrimination, including related to a hostile environment under the recipient’s education program or activity, as well as discrimination on the basis of sex stereotypes, sex characteristics, pregnancy or related conditions, sexual orientation, and gender identity
  • Clarify a recipient’s obligations to students and employees who are pregnant or experiencing pregnancy-related conditions.
