EPA Seeks Comments on Notice of Proposed Small MS4 General Permit in the Commonwealth of Puerto Rico

On March 31, 2022, the U.S. Environmental Protection Agency (EPA) issued a Notice of Proposed Small Municipal Separate Storm Sewer System General Permit (Small MS4 GP) in the Commonwealth of Puerto Rico under the National Pollution Discharge Elimination System Permit Program of the Clean Water Act. The proposed Small MS4 GP includes a new Storm Water Management Program template that is designed to assist MS4s in selecting and incorporating sections that provide guidance for the six minimum control measures. EPA has taken the position that the proposed general permit does not need to comply with the Regulatory Flexibility Act, nor must EPA consider the impact of the proposed Small MS4 GP on small businesses, small organizations, or small governments. Written comments on the notice are due by May 16, 2022.
