EPA Requests Comments on Proposed 2022 Financial Capability Assessment Guidance

On February 23, 2022, the Environmental Protection Agency (EPA) issued a notice and request for comments on its Proposed 2022 Financial Capability Assessment (FCA) Guidance. Municipalities whose discharges violate the Clean Water Act are required to address such violations per a schedule determined by the EPA. When developing a schedule, EPA considers factors such as public health, environmental protection, and a community’s financial capability. The Proposed FCA Guidance describes the financial information and formulas EPA intends to use to assess a community’s financial capability. EPA seeks comments on whether to consider lowest quintile income and poverty together. In addition, EPA seeks comments on what additional funding or financial factors should be considered. Comments are due by April 25, 2022.
