FWS Seeks Comments on Notice to Develop Permitting Program for Take of Migratory Birds
On October 4, 2021, the U.S. Department of the Interior’s Fish and Wildlife Service published an advance notice of proposed rulemaking to develop regulations that authorize incidental take of migratory birds under certain conditions. The Service is proposing three mechanisms by which it will authorize take under the Migratory Bird Treaty Act (MBTA) that include exceptions to the prohibition on incidental take, general permits, and specific or individualized permits. The Service is seeking public comment on specific criteria the agency would use to apply these authorizations to various activities. Written comments on the notice are due by December 3, 2021.
