EPA’s Review of Final Rules for the Five Persistent, Bioaccumulative, and Toxic Chemicals

On March 16, 2021, EPA opened a public comment period to review five recently published final rules to address persistent bioaccumulative, and toxic (PBT) chemicals under the Toxic Substance Control Act. The PBT final rules were issued on January 6, 2021 for the following chemicals: 2,4,6-tris(tert-butyl)phenol (2,4,6-TTBP); decabromodiphenyl ether (decaBDE); phenol, isopropylated phosphate (3:1) (PIP (3:1)); pentachlorothiophenol (PCTP); and hexachlorobutadiene (HCBD). In undertaking this effort, EPA intends to review these rules to determine whether and how to revise these five final rules in accordance with the recently issued Executive Orders by the President. EPA is requesting comments on whether further exposure reductions are practical and whether to consider additional approaches. EPA is also seeking comments on any implementation issues associated with these final rules, especially those associated with the compliance date for PIP (3:1). 

Comments are due on May 17, 2021.
