USPTO Announces Proposed Changes to Rules for Post-Grant Proceedings

On October 22, 2019, the United States Patent and Trademark Office (USPTO) published a Notice of Proposed Rulemaking that would change the rules of practice in post-grant proceedings before the Patent Trial and Appeal Board to shift the burden of persuasion for motions to amend to the petitioner, and to the patent owner for patentability of substitute claims.
