EPA Extends Deadlines on Two Clean Air Act Rules

What: On March 20, 2025, the U.S. Environmental Protection Agency (EPA) extended the deadlines for two Clean Air Act rules.

Why: The EPA announced an extension of the reporting deadline under the Greenhouse Gas (GHG) Reporting Rule for reporting year 2024 data from March 31, 2025, to May 30, 2025. The EPA also recently announced it would be reconsidering the rule in response to President Trump’s Executive Order 14154, Unleashing American Energy.

The EPA has certified that extending the deadline on the GHG Reporting Rule will not have a significant impact on a substantial number of small entities.

Separately, the EPA also announced it will extend the comment deadline for its proposed rule on National Emission Standards for Hazardous Air Pollutants: Chemical Manufacturing Area Sources Technology Review until April 14, 2025.

The proposed rule:

  • Establishes a new area source category to address chemical manufacturing process units (CMPUs) using ethylene oxide (EtO).
  • Lists EtO in table 1 to the National Emission Standards for Hazardous Air Pollutants (NESHAP) for Chemical Manufacturing Area Sources (CMAS).
  • Adds EtO-specific requirements to the CMAS NESHAP.
  • Adds a fence line monitoring program for EtO.
  • Proposes new requirements for pressure vessels and pressure relief devices.
  • Adds new leak detection and repair requirements to the CMAS NESHAP for equipment leaks in organic hazardous air pollutant service and heat exchange systems.
  • Proposes performance testing once every 5 years and to add provisions for electronic reporting.

The EPA has determined that the 58 small entities affected by the proposed rule may experience an average impact of total annual costs being 0.32 percent of their annual revenues.
