What: On January 17, 2025, the Alcohol and Tobacco Tax and Trade Bureau (TTB) published a proposed rule to require a labeling disclosure of all major food allergens used in the production of alcoholic beverages subject to TTB’s regulatory authority under the Federal Alcohol Administration Act. Under the proposed rule, unless an exception applies, labels must declare milk, eggs, fish, crustacean shellfish, tree nuts, wheat, peanuts, soybeans, and sesame. Labels must also disclose ingredients of alcoholic beverages that contain protein derived from the foods listed above. TTB proposes a compliance date of 5 years from the date that a final rule resulting from this proposal is published in the Federal Register.
Why: The proposed regulatory changes would amend existing regulations that list the mandatory label requirements on wine, distilled spirits, and malt beverages, respectively. TTB proposes to amend these sections to include mandatory allergen labeling requirements, with a cross-reference to the proposed new regulations that provide more detail about the mandatory allergen labeling requirements. TTB acknowledges several considerations directly related to the proposed labeling requirements and seeks comments on both wording and formatting.
TTB certified that this proposed rule, would not have a significant economic impact on a substantial number of small entities. TTB is seeking comments on the impact of the proposed regulations on small businesses.
Action: Submit comments to TTB on or before April 17, 2025.
