EPA Extends Deadline for Information Collection on the PFAS Use in Fluorinating Plastic Containers

What: On November 20, 2024, the U.S. Environmental Protection Agency (EPA) announced it would extend the deadline for a notice seeking information on the manufacture of certain per- and polyfluoroalkyl substances (PFAS), including perfluorooctanoic acid (PFOA), perfluorononanoic acid (PFNA), and perfluorodecanoic acid (PFDA) during the fluorination of plastic containers until December 30, 2024.

Why: The information will be used to evaluate the need for regulating these chemicals under the Toxic Substances Control Act (TSCA). Specifically, the EPA is looking for information on:

  • Number, location, and uses of fluorinated containers in the United States, including any uses critical to the national economy, national security, or critical infrastructure (which may include uses in medical devices);
  • Alternatives to the fluorination process that generates PFAS including PFOA, PFNA, and PFDA; and
  • Measures to address risk from PFOA, PFNA, and PFDA formed during the fluorination of plastic containers.

Comments due: The new deadline to submit public comments is December 30, 2024.
