On January 10, 2022, the Consumer Product Safety Commission (CPSC) published a proposed rule to establish safety standards for magnets. The rule would require that each loose or separable magnet that is part of a consumer product intended, designed, or marketed to be used for entertainment, jewelry, mental stimulation, stress relief, or a combination of these purposes, and that fits entirely within CPSC’s small cylinder, would be required to have a flux index of less than 50 kG2 mm2. CPSC states that all importers of magnet sets are considered small businesses. The rule will also impact small manufacturers. These small businesses are likely to incur costs to certify that the products meet the new requirements and may incur testing costs. There may also be lost income costs if these businesses could not produce or import compliant products. Small businesses are encouraged to review and comment on the Commission’s proposed rule and its initial Regulatory Flexibility Act analysis.
